1. Acceptance of Terms

By downloading, installing, or using Benescript ("the App"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

2. License Grant

We grant you a limited, non-exclusive, non-transferable license to use Benescript subject to these Terms and based on the license tier you purchase.

You may:

• Install and use the App on the number of devices permitted by your license tier
• Use the App for personal and commercial purposes
• Use enhanced text you create for any lawful purpose

You may not:

• Reverse engineer, decompile, or disassemble the App
• Redistribute, sublicense, or resell the App
• Use the App for any illegal purpose
• Remove any copyright or proprietary notices
• Share your license key with others

3. Free Trial and Pricing

Benescript offers a 7-day free trial with up to 10 text enhancements per day. After the trial period, free usage is limited to 2 enhancements per day.

For unlimited usage, you may purchase a one-time license. All licenses are one-time purchases with no recurring fees. Refund requests should be directed to us via email.

4. User Responsibilities

API Keys and Third-Party Services

When using cloud AI providers, Benescript requires you to provide your own API keys. You are responsible for complying with the terms of service of those providers and for any charges incurred through your use of their services. Local AI options (Apple Foundation Model, MLX local models, Ollama) do not require API keys or third-party accounts.

Content Responsibility

You are solely responsible for the text you process through Benescript and for ensuring your use complies with applicable laws and regulations.

5. Intellectual Property

Our Rights: Benescript, including its code, design, and branding, is owned by us and protected by intellectual property laws.

Your Rights: You retain all rights to the content you process using Benescript, including your original text and AI-enhanced output.

6. Disclaimers

Benescript is provided "as is" without warranties of any kind, either express or implied.

• Accuracy: We do not guarantee the accuracy of AI-enhanced text. You should always verify important content.
• Availability: We do not guarantee uninterrupted access to cloud AI services, which depend on third-party providers.
• Compatibility: We do not guarantee compatibility with all applications or macOS configurations.

7. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of Benescript.

8. Termination

You may stop using Benescript at any time by deleting the App from your Mac. We may terminate or suspend your license if we believe you have violated these Terms.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
